Welcome to EliteLabs. When I refer to “I”, “me”, or “my”, I mean EliteLabs. I run this website and store to offer you a carefully selected experience, including all information, content, features, tools, products, and services (the “Services”). The site operates on Shopify’s platform, which enables me to deliver these Services.

These terms and conditions, along with any policies referenced here (the “Terms of Service” or “Terms”), set out your rights and responsibilities when you use the Services.

I aim to give an accurate and honest representation of all products and services on my website. However, colours and appearance may look different depending on your device and its settings. I do not guarantee that the appearance or quality of any product or service you receive will exactly match what you see online or meet every expectation.
Product descriptions may be updated or changed at any time without notice. I may discontinue products or limit quantities for any person, location, or jurisdiction at my discretion.

When you place an order, you are making an offer to buy. I reserve the right to accept or decline any order for any reason. Your order is only confirmed once I’ve accepted it and processed your payment. Please check your order carefully before submitting, as I may not be able to accommodate cancellations after acceptance. If I do not accept, change, or cancel your order, I will try to notify you using the contact details you provided.

All purchases are subject to my Refund Policy.
You confirm that your purchases are for personal or household use only, and not for resale or export.

SECTION 4 – PRICES AND BILLING
Prices, discounts, and promotions may change at any time without notice. You will be charged the price shown at checkout, as confirmed in your order email. Unless clearly stated otherwise, prices do not include taxes, shipping, handling, customs, or import charges.

Prices on my website may differ from those in physical shops or other online stores. Sometimes, I may run promotions with separate terms—if there’s a conflict, the promotion terms apply.

You must provide accurate, current details for all purchases, including payment and account information. Keep your details up to date so I can process your orders and contact you if needed.

You confirm that: (i) all payment information you provide is true and complete, (ii) you are authorised to use the payment method, (iii) your payment provider will honour the charges, (iv) you will pay all charges shown at checkout, including shipping, handling, and any taxes.

SECTION 5 – SHIPPING AND DELIVERY
I am not responsible for shipping or delivery delays. All delivery times are estimates only. I am not liable for delays caused by carriers, customs, or events outside my control. Once I hand your order to the carrier, the risk and ownership pass to you.

All content on this site—including trademarks, brand names, text, images, graphics, reviews, video, audio, and the overall design—is owned by me or my licensors and is protected by intellectual property laws.

You may use the Services for your own personal, non-commercial use only. You must not copy, share, modify, display, publish, download, store, or transmit any material from the site without my written permission. These Terms do not grant you any rights to use my intellectual property, or that of Shopify or any third party, unless I’ve given clear written consent.

EliteLabs’ names, logos, product names, designs, and slogans are trademarks owned by me or my licensors. Do not use these without written permission. Shopify’s trademarks belong to Shopify. Any other names or logos on the site belong to their respective owners.

All rights not expressly given here are reserved.

SECTION 7 – OPTIONAL TOOLS
You may have access to tools or features provided by third parties through this site. I do not monitor, control, or have input into these tools.

Any third-party tools are made available “as is” and “as available”, without any guarantees or endorsements from me. I am not liable for any issues or losses that arise from your use of these optional tools.

If you choose to use any third-party tools, you do so at your own risk and should review and accept the terms set by the relevant provider.

In the future, I may introduce new features or resources as part of the Services. These will also be covered by these Terms of Service.

My Services may include links or content from third-party websites. I do not control or review the content or accuracy of these third-party sites. If you choose to access them, you do so at your own risk.

SECTION 9 – RELATIONSHIP WITH SHOPIFY
This site runs on Shopify’s platform, which allows me to provide these Services. All sales and purchases you make are directly with EliteLabs, not Shopify. By using the Services, you agree that Shopify is not responsible for any part of your transactions with EliteLabs, including any injury, damage, or loss related to products or services you purchase. You release Shopify and its affiliates from any claims, damages, or liabilities connected to your purchases or transactions with EliteLabs.

SECTION 10 – PRIVACY POLICY
Any personal information I collect through the Services is handled according to my Privacy Policy. Because this site is hosted on Shopify, some of your information may also be covered by Shopify’s Privacy Policy. By using the Services, you confirm that you have read both privacy policies.

Shopify collects and processes certain personal information related to your use of the Services so the site can function and improve. Information you provide may be shared with Shopify and third parties, some of whom may be based outside your country. You are responsible for what you post and its accuracy. I do not take responsibility for feedback posted by you or others.

You agree to indemnify and hold harmless EliteLabs, Shopify, and all related affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, claims, or costs (including reasonable legal fees) owed to any third party that arise from:

  2. Your violation of any law or another person’s rights
  3. Your use of the Services
If there’s a claim covered by this section, I’ll let you know. Not being notified straight away doesn’t remove your responsibility unless you’re seriously disadvantaged by the delay. I may handle the defence and settlement of such claims at your expense, but I won’t agree to any settlement that requires you to do anything other than pay money without your agreement (which you won’t unreasonably withhold). You must cooperate with me, including providing relevant documents, if needed for the defence.

If any part of these Terms is found to be unlawful, void, or unenforceable, that part will still be enforced as much as possible under the law. The rest of the Terms will remain valid and in effect.

If I don’t enforce any right or part of these Terms, it doesn’t mean I’ve waived that right.
These Terms, along with any policies or rules posted on this site, make up the entire agreement between you and me regarding your use of the Services. They replace any previous agreements or communications, whether written or spoken.
If any part of these Terms is unclear, it won’t be interpreted against the person who wrote it.

You can’t transfer, assign, or delegate any part of this agreement or your rights and obligations under these Terms without my written consent. Any attempt to do so is void. I may transfer, assign, or delegate these Terms and my rights and obligations at any time, without notice or your consent.

These Terms and any separate agreements for Services are governed by the laws and courts of the jurisdiction where EliteLabs is based. By using the Services, both you and I agree to submit to the venue and personal jurisdiction of those courts.

Headings in these Terms are for convenience only and do not affect the meaning or interpretation of any section.

SECTION 23 – CHANGES TO TERMS OF SERVICE
You can always find the latest version of these Terms on this page. I may update, change, or replace any part of these Terms at my discretion by posting updates here. It’s your responsibility to check for changes. If there are any material changes, I’ll notify you as required by law, and those changes will take effect on the date stated in the notice. If you continue to use the Services after changes are posted, you accept the updated Terms.
